Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your access to and use of websites, apps, and related services operated by Elysay under the elysay.com domain and its subdomains (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. Services covered

The Services include the Elysay hub and current and future apps hosted on elysay.com and *.elysay.com, such as Mathscapes (math practice), Listly (shared lists), and Auth (sign-in). Features may change, and new apps may be added under the same Terms unless a product publishes different terms.

3. Accounts and access

Some Services require an account. You are responsible for the accuracy of information you provide and for keeping credentials and session access secure. You must be able to form a binding contract in your jurisdiction. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.

Certain features (for example, shared Listly links) may be used without a personal account. Anyone you share a link with may view or edit content according to that feature’s design. You are responsible for who you share links with.

4. Acceptable use

You agree not to:

• Use the Services for unlawful, harmful, or abusive purposes
• Attempt to disrupt, probe, or reverse-engineer the Services beyond ordinary use
• Interfere with other users’ access or misuse shared links and invitations
• Upload or transmit malware, spam, or content you do not have rights to share
• Circumvent rate limits, authentication, or access controls

We may suspend or terminate access if we reasonably believe you have violated these Terms or that continued use would harm the Services or other users.

5. Your content

You retain ownership of content you submit (such as list items, worksheet preferences, or account profile data). You grant Elysay a limited license to host, process, and display that content solely to operate and improve the Services. You represent that you have the rights needed to submit that content.

6. Intellectual property

The Services, including software, branding, and design, are owned by Elysay or its licensors. These Terms do not grant you any ownership interest in the Services. You may not copy, modify, or redistribute our materials except as allowed by the Services’ ordinary features or with prior written permission.

7. Third-party services

The Services may rely on third-party infrastructure (for example, hosting, email delivery, or authentication providers). Your use of those providers may also be subject to their terms. We are not responsible for third-party services we do not control.

8. Disclaimers

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, Elysay disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation, or that the Services will meet your specific needs (including educational outcomes from Mathscapes worksheets).

9. Limitation of liability

To the fullest extent permitted by law, Elysay and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Services. Our aggregate liability for claims relating to the Services will not exceed the greater of (a) the amounts you paid us for the Services in the twelve months before the claim, or (b) fifty U.S. dollars (US $50), if you have not paid us.

10. Changes

We may update these Terms from time to time. The “Last updated” date at the top of this page will change when we do. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms. If you do not agree, stop using the Services.
